Terms of Service

These Terms of Service (“Terms”) govern your use of services provided by Silverform Systems, operated by John Berkey doing business as Silverform Systems (“we,” “us,” or “our”).

By purchasing, accessing, or using our services, you agree to these Terms.

1. Services

We provide setup and month-to-month access to a missed-call text-back system and AI SMS response agent for business use. Services may include phone number purchase/setup, A2P registration assistance, call forwarding setup guidance, and AI SMS workflow configuration.

2. No Guarantee of Results

We do not guarantee any specific number of leads, booked appointments, response rates, revenue, or business outcomes.

3. Fees

Services may include a one-time setup fee and recurring monthly service fees. All pricing is disclosed at checkout, in an invoice, or in a separate agreement.

4. Refunds

Setup fees are refundable only within the first thirty (30) days after service start unless otherwise stated in writing.

Monthly fees are non-refundable once charged.

5. Cancellation

Services are provided on a month-to-month basis unless otherwise stated.

Cancellation requires at least seven (7) days’ notice before the next billing date and takes effect at the end of the current billing period.

6. Acceptable Use

You agree not to use the service for unlawful, deceptive, abusive, spam, or non-compliant communications. You are responsible for ensuring your business practices and customer communications comply with applicable law.

7. Customer Consent

You are responsible for obtaining any legally required customer consent for texts or related communications connected to your business.

8. Ownership

We retain ownership of the GoHighLevel subaccount, purchased service phone number, automations, workflows, prompts, and related configurations unless we agree otherwise in writing.

You retain ownership of your original business phone number and your own separate business assets not created by us.

9. AI Responses

The service may use automated or AI-generated SMS responses. These responses may not always be accurate, complete, or suitable. You are responsible for evaluating whether the service fits your business needs.

10. Support

Support is provided on a reasonable-efforts basis. We do not guarantee support hours, response times, or uninterrupted service.

11. Suspension or Termination

We may suspend or terminate service for nonpayment, misuse, suspected unlawful activity, or violation of these Terms.

12. Disclaimer of Warranties

Services are provided “as is” and “as available” without warranties of any kind, express or implied.

13. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or lost-profit damages.

Our total liability for any claim will not exceed the amount you paid us during the two (2) months before the event giving rise to the claim.

14. Governing Law

These Terms are governed by the laws of Arizona.
